Short analysis on how the existence of an effective administration of justice is counterproductive to neoliberal society and how that society is trying to dismantle it attacking its citizens’ right to defense. Special attention will be given to the concept of “Enemy Criminal Law”.
Análisis sobre cómo la existencia de un sistema de administración de justicia eficaz es contraproducente para la sociedad neoliberal y cómo esta sociedad está tratando por ello de desmontarlo, atacando el derecho de defensa de los/las ciudadanos/as. Se tratará con especial atención el concepto de Derecho Penal del Enemigo.

1.-Impact of the ‘crisis’ over citizens’ rights:
-Neoliberal offensive over justice resources:
-Dismantling the Official Justice System
-Problems with free, legal aid service.
-New tax on the use of the justice system.
-Concentration on reducing fundamental rights:
-Penal code reform, penalization of calling for public roots activities,
increased penalties for some faults/crimes.
-Threats to reform the Organic Law 1/1992, fobidding to video police.
-Suggestive rumours about “modulating” the right to meet, about
turning passive resistance into an attempt to commit…
-About how budget cuts do not reach the Interior Ministry’s UIP: swat teams, or national anti-disturbance forces.
-Purchase of swat team materials.
-Purchase of bullet-proof vests, but no investment in showing an ID#
on them.
-Announcement of purchase of video camaras for the agents to carry
on their interventions.
2.-”Enemy Criminal Law”: When the state treats citizens as adversaries:
-Criminalization of social protest: The “antisystem” in the media.
-Actual repression:
-High impact: 221 arrested and hundreds of lessions.
-Low impact: 752 sanctioned, €225,600 collected in fines.
-Impossibility to report: Systematic dismissal for inability to
identify the police agent involved in the acts, since there is no ID#.
-National court offensive: First in Catalonia, now in Madrid. Judicial
process irregularities.
-Preventive arrest as a threat.
-The judicial as an obstacle: The “illegal” concentrations as
justification for police action.
3.-Consequences of the process:
-De-mobilization, fear and repression: The “silent majority” vs. the
beaten citizens. What democracy do we want?
-Denial of access to effective defense: Indefension against the
repressive state. How to defend oneself? Fictitious separation of
powers.

1.-Impactos de la crisis sobre los derechos ciudadanos:
-Ofensiva neoliberal sobre los recursos de justicia:
-Desmantelamiento del SOJ.
-Problemas con el turno de oficio.
-Ley de tasas.
-Concentración de los recortes en los derechos fundamentales:
-Reforma del Código Penal, penas sobre difusión de convocatorias,
endurecimiento de algunos delitos.
-Amenaza de reforma de la LO 1/1992: prohibición de grabar a policías.
-Globos sonda sobre “modulación” del derecho de reunión, sobre
convertir la resistencia pasiva en atentado.
-De cómo los recortes no alcanzan a las Unidades de Intervención Policial del Ministerio del Interior:
-Compra de material antidisturbios.
-Compra de chalecos antibala, pero no hay inversión en ponerles el
número de placa.
– Anuncio de compra de cámaras para que lleven los agentes en las intervenciones.
2.-Derecho Penal del Enemigo: cuando el Estado trata a los ciudadanos
como adversarios:
-Criminalización de la protesta social: los “antisistema” en los medios
-Represión real:
-de alta intensidad: 221 detenidos y centenares de lesionados
-de baja intensidad: 752 sancionados, 225.600€ de recaudación
-La imposibilidad de denunciar: archivo sistemático por imposibilidad de identificar al agente autor de los hechos al no ir identificado con su número de placa
-La ofensiva de la Audiencia Nacional: primero en Cataluña, ahora en Madrid. Irregularidades procesales.
-La prisión preventiva como amenaza
-Lo jurídico como desincentivo: las concentraciones “ilegales” como justificación de la actuación policial
3.-Consecuencias del proceso:
-Desmovilización, miedo y represión: la “mayoría silenciosa” vs la
ciudadanía apaleada ¿Qué democracia queremos?
-Imposibilidad de acceso a la defensa efectiva: indefensión frente al
Estado represor ¿Cómo defenderse? Ficticia separación de poderes
